GENERAL TERMS AND CONDITIONS OF THE ONLINE SHOP www.martinwieland.at<\/a><\/p>

  1. General<\/li><\/ol>

    All services provided by the online shop to the customer are exclusively based on the following General Terms and Conditions. Deviating regulations only apply if they have been agreed upon in writing between the online shop and the customer.<\/p>

    1. Conclusion of Contract<\/li><\/ol>

      Only individuals who have reached the age of 18 and have unrestricted legal capacity at the time of contract conclusion are entitled to conclude a contract with the online shop.<\/p>

      The offers of the online shop on the Internet are a non-binding invitation to the customer to order goods in the online shop.<\/p>

      By ordering goods from the online shop on the Internet, the customer implicitly makes a binding offer to conclude a purchase contract.<\/p>

      The online shop is entitled to accept this offer within 5 calendar days by sending an order confirmation. The order confirmation is sent by email, but no later than upon delivery of the goods. If the 5-day period expires without a response, the offer is considered rejected.<\/p>

      1. Delivery Times<\/li><\/ol>

        All items will be promptly delivered, subject to availability and as long as supplies last.<\/p>

        Delivery is only available within Austria. The delivery time is usually 4-5 working days and starts with the dispatch of the order confirmation. The delivery time provided is non-binding, unless there is a different written agreement.<\/p>

        If an item is temporarily unavailable, we will inform you via email about the expected delivery time, provided we have your address.<\/p>

        In the event of delivery delays due to force majeure, transportation disruptions, government actions, or other events beyond the control of the online shop, no claim for damages can be made against the online shop.<\/p>

        If the delivery is delayed or fails due to the fault of suppliers (impossibility), the online shop is not responsible for it.<\/p>

        1. Shipping<\/li><\/ol>

          The shipping costs vary depending on the weight of the products and the destination. Upon customer's request, express deliveries can be arranged. The additional costs incurred will be borne by the customer.<\/p>

          Transport insurance will be arranged at the customer's expense. Any transport damages must be reported to the carrier immediately.<\/p>

          1. Prices and Payment<\/li><\/ol>

            5.1 All prices stated are final prices including the currently applicable value-added tax of 20%.<\/p>

            5.2 The final prices do not include the costs of packaging and shipping.<\/p>

            5.3 Due to the constant updating of the online shop's website, any information regarding price and quality of the products previously provided will no longer be valid. Errors and printing mistakes are reserved.<\/p>

            5.4 The price stated at the time of the customer's offer submission is decisive for invoicing.<\/p>

            5.5 Payment for the goods can be made either in advance, via PayPal, or on account. Exceptions are only valid if agreed upon in writing between the online shop and the customer.<\/p>

            5.6 The customer is obliged to promptly settle the invoice amount upon receipt of the goods.<\/p>

            5.7 If the customer fails to fulfill the payment obligation after the expiry of the period mentioned in paragraph 6, the online shop reserves the right to charge the customer for any additional reminder and processing fees.<\/p>

            5.8 If the customer is in default of payment, the online shop is entitled to claim statutory default interest. This does not affect the online shop's right to assert further claims for damages, if applicable.<\/p>

            1. Reservation of Ownership<\/li><\/ol>

              The ordered goods remain the property of the online shop (reservation of ownership) until full payment has been made. In the event of the customer's payment default, the online shop is entitled to take back the goods. This does not constitute a withdrawal from the contract, unless expressly stated.<\/p>

              1. Warranty<\/li><\/ol>

                7.1 Customer claims against the online shop arising from a defect in the goods are subject to statutory provisions.<\/p>

                7.2 The customer undertakes to examine the goods for any defects upon receipt and to immediately notify the online shop if any such defects are discovered. If the customer later discovers that the goods are defective, they are obliged to inform the online shop immediately upon discovery. If the customer fails to report a defect, the goods shall be deemed approved.<\/p>

                7.3 Damages caused by improper or non-contractual handling by the customer are not considered defects. The manufacturer's specifications for the goods are decisive for determining improper handling and non-compliance.<\/p>

                7.4 The warranty period is two years and begins upon receipt of the goods.<\/p>

                7.5 The warranty is void in all cases of intervention, repairs, or attempted repairs by the buyer or unauthorized third parties.<\/p>

                1. Limitation of Liability<\/li><\/ol>

                  Unless otherwise provided below, further customer claims, regardless of their legal basis, are excluded. Therefore, the online shop is not liable for damages that did not occur to the delivered goods themselves; in particular, the online shop is not liable for lost profits or other financial losses of the customer. To the extent that the contractual liability of the online shop is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents.<\/p>

                  The above limitation of liability does not apply in case of intent or gross negligence or in case of personal injury. It also does not apply if the customer asserts legally regulated claims.<\/p>

                  The provisions of the Product Liability Act remain unaffected. If the online shop negligently violates a material contractual obligation, the liability for property damages is limited to the typically foreseeable damage.<\/p>

                  If subsequent performance is carried out by means of replacement delivery, the buyer is obliged to return the initially delivered goods to the online shop at the latter's expense within 30 days.<\/p>

                  The return of defective goods must be made in accordance with the statutory provisions. The online shop reserves the right to claim damages under the legally regulated conditions.<\/p>

                  The limitation period is two years, starting from the delivery of the item.<\/p>

                  1. Data Protection<\/li><\/ol>

                    The customer agrees that their personal data provided to the online shop as part of the business relationship will be electronically stored and processed. It should be noted that data collected within the scope of this provision will be used exclusively for the purpose of providing services, in particular for order processing and accounting. The online shop does not disclose customer data to third parties.<\/p>

                      All displayed third-party logos, images, and graphics are the property of the respective companies and are subject to the copyright of the respective licensors. All photos, logos, texts, reports, scripts, and programming routines displayed on these pages, which are our own developments or have been prepared by us, may not be copied or otherwise used without our consent.                       1. Jurisdiction: Neunkirchen<\/li><\/ol>

                        11.1 The place of jurisdiction is, unless otherwise provided by law, the registered office of the online shop.<\/p>

                        11.2 Austrian law, excluding the conflict of laws provisions, applies to all disputes that may arise from this legal relationship. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.<\/p>

                            By placing an order, the customer acknowledges and accepts the General Terms and Conditions of the online shop. Should any provision of these General Terms and Conditions be invalid for any reason, the validity of the remaining provisions shall remain unaffected. Oral agreements require written confirmation to be effective.<\/p>

                            1.\u00a0\u00a0 \u00a0Allgemeines<\/p>

                            Alle Leistungen, die vom Onlineshop f\u00fcr den Kunden erbracht werden, erfolgen ausschlie\u00dflich auf der Grundlage der nachfolgenden Allgemeinen Gesch\u00e4ftsbedingungen. Abweichende Regelungen haben nur dann Geltung, wenn sie zwischen Onlineshop und Kunde schriftlich vereinbart wurden.<\/p>

                            2.\u00a0\u00a0 \u00a0Vertragsschluss<\/p>

                            Zum Vertragsschluss mit dem Onlineshop sind nur Personen berechtigt, die das 18. Lebensjahr vollendet haben und zum Zeitpunkt des Vertragsschlusses in ihrer Gesch\u00e4ftsf\u00e4higkeit nicht beschr\u00e4nkt sind.<\/p>

                            Die Angebote des Onlineshops im Internet sind eine unverbindliche Offerte an den Kunden, im Onlineshop Waren zu bestellen.<\/p>

                            Durch die Bestellung von Waren des Onlineshops im Internet gibt der Kunde konkludent ein verbindliches Anbot auf Abschluss eines Kaufvertrages ab.<\/p>

                            Der Onlineshop ist berechtigt, dieses Angebot innerhalb von 5 Kalendertagen durch Zusendung einer Auftragsbest\u00e4tigung anzunehmen. Die Auftragsbest\u00e4tigung erfolgt durch\u00a0 Email\u00a0 sp\u00e4testens aber mit Lieferung der Ware. Nach unbeantwortetem Ablauf der\u00a0\u00a0\u00a0\u00a0 5 -Tages-Frist gilt das Angebot als abgelehnt.<\/p>

                            3.\u00a0\u00a0 \u00a0Lieferzeiten<\/p>

                            Alle Artikel werden umgehend, sofern ab Lager verf\u00fcgbar und nur solange der Vorrat reicht, ausgeliefert.<\/p>

                            Die Lieferung erfolgt nur innerhalb \u00d6sterreichs. Die Lieferzeit betr\u00e4gt in der Regel\u00a0\u00a0\u00a0 4-5\u00a0 Werktage und beginnt mit dem Versand der Auftragsbest\u00e4tigung. Die Angabe der Lieferzeit ist unverbindlich, es sei denn, es gibt eine anders lautende schriftliche Vereinbarung.<\/p>

                            Sollte ein Artikel kurzfristig nicht verf\u00fcgbar sein, informieren wir Sie per e-Mail \u00fcber die zu erwartende Lieferzeit, sofern uns eine Adresse von Ihnen vorliegt.<\/p>

                            Bei Lieferungsverz\u00f6gerungen, wie z.B. durch h\u00f6here Gewalt, Verkehrsst\u00f6rungen und Verf\u00fcgungen von hoher Hand sowie sonstige von dem Onlineshop nicht zu vertretende Ereignisse, kann kein Schadensersatzanspruch gegen den Onlineshop geltend gemacht werden.<\/p>

                            Ist die Lieferung durch das Verschulden von Vorlieferanten verz\u00f6gert und unterblieben (Unm\u00f6glichkeit), so hat der Onlineshop daf\u00fcr nicht einzustehen.<\/p>

                            4.\u00a0\u00a0\u00a0 Versand<\/p>

                            Die Versandkosten differieren je nach Gewicht der Produkte und Bestimmungsort.
                            Auf Wunsch des Kunden k\u00f6nnen auch Eillieferungen durchgef\u00fchrt werden. Die dabei\u00a0 entstehenden zus\u00e4tzlichen Kosten tr\u00e4gt der Kunde.<\/p>

                            Auf Kosten des Kunden wird eine Transportversicherung abgeschlossen. Transportsch\u00e4den sind unverz\u00fcglich dem Zusteller zu melden.<\/p>

                            5.\u00a0\u00a0 \u00a0Preise und Zahlung<\/p>

                            5.1\u00a0\u00a0 \u00a0Alle angegebenen Preise sind Endpreise, die die gesetzliche Mehrwertsteuer von derzeit 20 % beinhalten.<\/p>

                            5.2\u00a0\u00a0 \u00a0Die Endpreise inkludieren nicht die Kosten f\u00fcr Verpackung und Versand.<\/p>

                            5.3\u00a0\u00a0 \u00a0Durch die st\u00e4ndige Aktualisierung der Internetseiten des Onlineshops, verlieren zu einem fr\u00fcheren Zeitpunkt gemachte Angaben bez\u00fcglich Preis und Beschaffenheit der Ware ihre G\u00fcltigkeit. Irrt\u00fcmer und Druckfehler bleiben vorbehalten.<\/p>

                            5.4\u00a0\u00a0 \u00a0Der ausgewiesene Preis zum Zeitpunkt der Abgabe des Angebots des Kunden ist f\u00fcr die Rechnungsstellung ma\u00dfgeblich.<\/p>

                            5.5\u00a0\u00a0 \u00a0Die Bezahlung der Waren erfolgt entweder per Vorauskasse, via Paypal oder auf Rechnung. Ausnahmen haben nur dann G\u00fcltigkeit, wenn sie zwischen dem Onlineshop und dem Kunden schriftlich vereinbart wurden.<\/p>

                            5.6\u00a0\u00a0 \u00a0Der Kunde ist verpflichtet, den Rechnungsbetrag prompt nach Erhalt der Ware der zu begleichen.<\/p>

                            5.7\u00a0\u00a0 \u00a0Ist der Kunde seiner Zahlungsverpflichtung nach Ablauf der in Absatz 6 genannten Frist nicht nachgekommen, so beh\u00e4lt sich der Onlineshop das Recht vor, daraus entstehende zus\u00e4tzliche Mahn- und Bearbeitungsgeb\u00fchren dem Kunden in Rechnung zu stellen.<\/p>

                            5.8\u00a0\u00a0 \u00a0Ger\u00e4t der Kunde mit der Zahlung in Verzug, so ist der Onlineshop berechtigt, Verzugszinsen in gesetzlich vorgeschriebener H\u00f6he geltend zu machen. Das Recht des Onlineshops, eventuell weitergehende Schadensersatzanspr\u00fcche geltend zu machen, bleibt hiervon unber\u00fchrt.<\/p>

                            6.\u00a0\u00a0 \u00a0Eigentumsvorbehalt<\/p>

                            Bis zur vollst\u00e4ndigen Bezahlung bleiben die bestellten Waren Eigentum des Onlineshops (Eigentumsvorbehalt). Bei Zahlungsverzug des Kunden sind ist der Onlineshop berechtigt, die Ware zur\u00fcckzunehmen. Darin liegt kein R\u00fccktritt vom Vertrag, es sei denn dieser wird ausdr\u00fccklich erkl\u00e4rt.<\/p>

                            7.\u00a0\u00a0 \u00a0Gew\u00e4hrleistung<\/p>

                            7.1\u00a0\u00a0 \u00a0Die aus einem Mangel der Ware begr\u00fcndeten Anspr\u00fcche des Kunden gegen den Onlineshop richten sich nach den gesetzlichen Vorschriften.<\/p>

                            7.2\u00a0\u00a0 \u00a0Der Kunde verpflichtet sich, die Ware bei Entgegennahme auf etwaige M\u00e4ngel zu untersuchen und bei Feststellung eines solchen umgehend den Onlineshop dar\u00fcber in Kenntnis zu setzen. Sollte der Kunde zu einem sp\u00e4teren Zeitpunkt feststellen, dass die Ware mangelhaft ist, so ist er verpflichtet, den Onlineshop sofort nach Entdeckung desselben zu informieren. Unterl\u00e4sst es der Kunde, einen Mangel anzuzeigen, gilt die Ware als genehmigt<\/p>

                            7.3.\u00a0\u00a0 \u00a0Als Mangel an der Ware z\u00e4hlen nicht Sch\u00e4den, die der Kunde durch unsachgem\u00e4\u00dfe oder vertragswidrige Behandlung verursacht hat. Ausschlaggebend f\u00fcr die Unsachgem\u00e4\u00dfheit und Vertragswidrigkeit sind die Angaben des Herstellers der Ware.<\/p>

                            7.4.\u00a0\u00a0 \u00a0Die Gew\u00e4hrleistungsfrist betr\u00e4gt zwei Jahre. Sie beginnt mit dem Erhalt der Ware zu laufen.<\/p>

                            7.5.\u00a0\u00a0 \u00a0Die Gew\u00e4hrleistung erlischt in jedem Fall bei Eingriffen, Reparaturen oder Reparaturversuchen des K\u00e4ufers oder nicht autorisierter Dritter.<\/p>

                            8.\u00a0\u00a0 \u00a0Haftungsbeschr\u00e4nkung<\/p>

                            Soweit sich nachstehend nichts anderes ergibt, sind weitergehende Anspr\u00fcche des Kunden, gleich aus welchen Rechtsgr\u00fcnden, ausgeschlossen. Der Onlineshop haftet deshalb nicht f\u00fcr Sch\u00e4den, die nicht am Liefergegenstand selbst entstanden sind; insbesondere haftet Onlineshop nicht f\u00fcr den entgangenen Gewinn oder sonstige Verm\u00f6genssch\u00e4den des Kunden. Soweit die vertragliche Haftung vom Onlineshop ausgeschlossen oder beschr\u00e4nkt ist, gilt dies auch f\u00fcr die pers\u00f6nliche Haftung von Arbeitnehmern, Vertretern und Erf\u00fcllungsgehilfen.<\/p>

                            Vorstehende Haftungsbeschr\u00e4nkung gilt nicht, soweit die Schadensursache auf Vorsatz oder grober Fahrl\u00e4ssigkeit beruht oder ein Personenschaden vorliegt. Sie gilt ferner dann nicht, wenn der Besteller gesetzlich geregelte Anspr\u00fcche geltend macht.<\/p>

                            Die Bestimmungen des Produkthaftungsgesetzes bleiben hiervon unber\u00fchrt. Sofern der Onlineshop fahrl\u00e4ssig eine vertragswesentliche Pflicht verletzt, ist die Ersatzpflicht f\u00fcr Sachsch\u00e4den auf den typischerweise entstehenden Schaden beschr\u00e4nkt.<\/p>

                            Ist die Nacherf\u00fcllung im Wege der Ersatzlieferung erfolgt, ist der Besteller dazu verpflichtet, die zuerst gelieferte Ware innerhalb von 30 Tagen an den Onlineshop auf Kosten desselben zur\u00fcckzusenden.<\/p>

                            Die R\u00fccksendung der mangelhaften Ware hat nach den gesetzlichen Vorschriften zu erfolgen. Der Onlineshop beh\u00e4lt sich vor, unter den gesetzlich geregelten Voraussetzungen Schadensersatz geltend zu machen.<\/p>

                            Die Verj\u00e4hrungsfrist betr\u00e4gt zwei Jahre. Fristbeginn erfolgt mit Lieferung der Sache.<\/p>

                            9.\u00a0\u00a0 \u00a0Datenschutz<\/p>

                            Der Kunde ist damit einverstanden, dass seine, dem Onlineshop im Rahmen der Gesch\u00e4ftsbeziehung zugehenden pers\u00f6nlichen Daten, elektronisch gespeichert und verarbeitet werden. Es wird darauf hingewiesen, dass im Sinne dieser Bestimmung ermittelte Daten ausschlie\u00dflich f\u00fcr Zwecke der Leistungserbringung, insbesondere zum Zweck der Auftragsabwicklung und der Buchhaltung erhoben und verarbeitet werden. Der Onlineshop gibt Kunden-Daten nicht an Dritte weiter.<\/p>
